Mark E. Torian
Mark E. Torian joined Sayles Werbner in 2004, and has been practicing trial law in Texas since 2000. Before beginning his practice, Mark served in the United States Marine Corps where he was assigned to Diplomatic Security with the United States Department of State. Mark's practice is concentrated on trial work in the areas of complex commercial litigation, personal injury and products liability in both state and federal courts. He also handles matters before the Financial Industry Regulatory Authority.

An experienced litigator, Mark has tried more than 20 criminal and civil lawsuits to verdict. His litigation experience includes:
  • Substantial plaintiff's verdict in a lawsuit involving the breach of an oral partnership agreement in a commercial real estate development deal that involved the determination of interest in past and future net profits.
  • Successful defense of a drilling company in a breach of contract lawsuit brought by investors. The claim involved the disruption of the deepest corkscrew gas well in the world at the time.
  • Successful defense of an insurer in a breach of contract lawsuit brought by an international hotel chain that sought business interruption losses for all hotels in North America and the Caribbean due to the September 11, 2001, terrorist attacks.
  • Successful defense of a client in a bench trial where the opposing party sought more than $1 million based on breach of contract allegations, and obtaining a sizable judgment on his clients’ counterclaims.
  • Successful defense of a Fortune 50 Company in a jury trial where the opposing party sought more than $1 million in breach of contract claims, including obtaining a substantial judgment for his clients based on counterclaims for misappropriation of trade secrets, theft of trade secrets, and conspiracy to breach duty of confidentiality.
  • Successful summary judgment on behalf of corporate client in multi-million dollar complex insurance dispute.

Mark graduated magna cum laude from the University of Central Arkansas where he was a charter member of the University Boxing Club. He earned his law degree magna cum laude from the University of Arkansas School of Law. During law school, Mark was a member of the Arkansas Law Review and was awarded the Pearson Fellowship in both 1998 and 1999; an honor based on ethical character in the law and public service.
