Mark E. Torian
Mark E. Torian joined Sayles Werbner in 2004 and has been practicing trial law in Texas since 2000. Before he began his practice, Mark served in the United States Marine Corps, where he was assigned to Diplomatic Security with the United States Department of State. Mark's practice is concentrated on trial work in the areas of complex commercial litigation, personal injury and products liability in both state and federal courts. He also handles matters before the NASD.

Mark's legal experience includes:

  • Obtaining a $1.6 million plaintiff's verdict based on breach of an oral partnership agreement in a commercial real estate development context, involving the determination of past and future net profits interest.
  • Successfully helping to defend a drilling company in a breach of contract action brought by investors, involving the disruption of the deepest corkscrew gas well in the world at the time.
  • Successfully helping to defend an insurer from a breach of contract claim brought by an international hotel chain seeking business interruption losses for all hotels in North America and the Caribbean, due to the September 11, 2001, terrorist attacks on the World Trade Center towers and the Pentagon.
  • Successfully defending a client in a bench trial wherein the opposing party sought over $1 million on a breach of contract claim, and obtaining a judgement of over $240,000 on his clients counterclaims.
  • Successfully defending Fortune 50 Company in a jury trial wherein opposing party sought over $1 million on breach of contract claims, and obtaining a judgement of over $400,000 on his clients counterclaims for misappropriation of trade secrets, theft of trade secrets, and conspiracy to breach duty of confidentiality.

Mark graduated magna cum laude from the University of Central Arkansas where he was a charter member of the University Boxing Club. He received his law degree magna cum laude from the University of Arkansas School of Law. Mark was a member of the Arkansas Law Review and was awarded the Pearson Fellowship in both 1998 and 1999; an honor based on ethical character in the law and public service.
