Sayles Werbner Attorneys Argue for Commil USA at US Supreme Court
WASHINGTON, D.C. – Attorneys from Dallas’ Sayles Werbner recently appeared before the U.S. Supreme Court in Washington, D.C., to give oral arguments on behalf of Commil USA.
Firm founders Mark S. Werbner and Richard A. “Dick” Sayles represented Commil in the company’s arguments against computer networking company Cisco Systems Inc. (NASDAQ: CSCO). The Sayles Werbner team also included firm attorneys Mark D. Strachan and Darren P. Nicholson.
Many legal observers are calling the case one of the highest-profile patent infringement claims in years to reach the nation’s highest court. Based in The Woodlands, Texas, Commil is owned by attorney Jonathan David.
“It was exciting, but very challenging,” says Werbner, who delivered the arguments on March 31. “We were up against a tough opponent and it took a team effort to bring the case this far. We are hopeful that the Court adopts the liability standard for inducing infringement, which we and Commil argued.”
The Supreme Court decided to hear the case after a lower appellate court vacated a $74 million patent infringement judgment won by Sayles Werbner on Commil’s behalf in 2011. Jurors in the U.S. District Court for the Eastern District of Texas returned the multimillion-dollar verdict after finding that Cisco had infringed a Commil patent covering wireless-transmission technology.
Cisco appealed, claiming the company should not be held liable because it did not believe the contested patent was valid. Both companies will learn the case’s fate when the Supreme Court issues its decision, likely in June.
